Take a look at the obverse of a United States $1 bill and you will find many "pagan" symbols. The American flag has 13 strips (I hope American's are not superstitioius). Pagan symbology can be found in public buildings troughout our land.
However to get this thread back on track, the United States is a country ruled by law not religious beliefs. The only Governmental agency that has the right and Constitutional authority to make law is the Congress. The Supreme Court's roll is to enforce the U.S. Constitution. What is interesting about the Supreme Court is the justices are able to interpret the U.S. Constitution through their own personal ideology. Roe vs. Wade is a good example since the U.S. Constitution does not give American's the "right to privacy". In fact by its very nature the U.S. Constitution limits our right to privacy by giving the Government the right to legislate and regulate certain aspects of our lives.
For example drinking and driving is illegal in all states. An individual can be punished for driving under the influence even if they do not hurt someone else. What is being legislated is the "potential" of hurting others. Now if Congress applied the "potential" of hurting others in all situations then tobacco, alcohol, the internal combustion engine, and many other human behaviors (like porn) should be outlawed since there is the "potential" that (as you phrased it) "anything can be damaging if taken to extremes".
