Homosexual Discussion ForumWhy Wouldnt Christans Support Gay Marriage from a Moral..You are painting with too broad a brush, even if most homosexual relationships are not monogamous that is no reason to deny the rest of us that are decent monogamous people(I am downright puritanical compared to most homosexual men) the right to get married in a legal sense. The problem with not being able to get married(in a legal sense) is that we can be denied hospital visitation inheritance and a whole mess of other protections based upon that lack of marital status.
I did in a previous post if you want me to repost it... Even if I hadnt done so, you still have no leg to stand on, because homosexual relationships by right ought to have the same legal status as a heterosexual one, as there is no reason to logically deny that status. But it is irrelevant unless you can prove that ALL homosexual men behave in that manner. I am living proof that they dont. That it does, on multiple levels actually. Not only does it deny legal protections to a group of people, but I could even make a case that it violates pre-existing gender discrimination laws on the federal books. The problem with not allowing gay marriage is that they define these discriminatory laws as being remedied by marriage, then exclude a class of people from being able to remedy them. WHat christians as a whole need to remember is that they do not own the word marriage. It is a legal institutionas well as a (seperate) religious one. ANd while a church can refuse to marry whomever they so choose, the state, because it represents the whole of the people not just the majority, does not enjoy that luxury. JUst a nitpick: The US is not a democracy, but a constitutional republic, and the constitution is in essence a mandate, and the will of the people cannot override the constitution as it explicitly limits them in power in order to protect the minority As for the bit about the court system As for marriage laws, the 14th amendment guarantees that all legal protections and priviledges enjoyed in one state are applied to every single state, the highest common denominator, so to speak, as all US citiaens are protected equally under the law. This gives the federal courts jurisdiction. DOubly so because marriage is not only covered in state law, but ALSO grants benefits and protections at the FEDERAL level. It is, but not entirely.
