They said it first. Only if such a case comes before them... as I assume it will, once some states permit gay marriage and others forbid them. And I'm not asking them to extend specific advantages. I'm hoping that they'll rule that refusing to permit gay couples to marry unfairly deprives them of what the Court has, in the past, acknowledged as a fundamental right, violating the fundamental principles of equality established in the 14 Amendment, etc. and so on. Actually, I'm mostly hoping that my state Supreme Court will rule in favor of the case currently before them, a much more concrete possibility. But that may open a can of worms for other states... in a good way, as far as I'm concerned. Actually, it seems that people are doing that in Massachusetts, too. I only got the email soliciting support of it at my work address, though, so I don't have the details. A point -- though once the case was before them, they certainly made some sweeping statements in their ruling. But what happens when gay people can marry in certain states, but may end up living in states that don't recognize their marriages? I think I need to do more research... presumably this ground has been covered, in the history of U.S. marriage. |
