I have to agree with Julie, the 14th Ammendment does not cover same-sex unions.

The "democratic rules of engagement" require an act of Congress, not the majority opinion of 9 appointed judges.
What you are proposing is rule by oligarchy, not democracy. When 9 unelected judges can make law we cease to be a democracy.
