From your posts you have an intellectual and emotional agenda in promoting gay unions and not an experiential basis for your reasons to legalize gay unions. The idea that gay relationships are short-lived only because society will not legalize them is ludicrous. I know ever-straights who because of financial reasons are living together without formalizing their relationship through marriage that are monogamous and have been together for decades. It is not the piece of paper that has kept them together it is the personal commitment to the relationship. A good attorney can draw up a will that includes a living trust that gives any gay man or lesbian the right to leave their possessions to whom they want, set up a medical trust so their partner has authority in health matters including burial arrangements. Until this last tax reform married's filing joint tax returns were penalized, so it is actually better to file as single. If you fear a probate court will not probate a will as you want then there is the revocable or irrevocable trust route. This deeds real property to another individual before death and removes such property from probate. There are legal means to get what you want without "civil unions". Medical insurance is about the only issue that is valid for your side of this debate, however, some major companies offer “partners benefits” that take this into account. BTW, most corporations are cutting back on medical fringe benefits due to cost, so it is to the benefit of working couples to carry individual medical coverage with their own employers, so this voids that issue. Now, as to property owned in common it can be insured in both names as long as both names are on the title or deed. If the issue is a business, it can be set up as a partnership with the surviving partner having legal ownership of the business assets upon the death of the deceased partner without any financial remuneration to the deceased’s family. Any good attorney can handle this. Life insurance is exempt from probate and any person who purchases life insurance has the right to name any beneficiary they choose and the insurance company has the obligation to pay the beneficiary. The idea that probate courts tie up assets may be true however, liquid assets such as bank accounts can be set up with joint tenancy or right of survivorship which allows either partner access to the cash upon the death of the other. This is also true of stocks and bonds. My lesbian niece and her partner have has an attorney draw up the necessary legal documents to give each other custody of their children (both have given birth to a child via artificial insemination) and their home is in joint ownership as are both cars. I have already set up the legal framework to disinherit my biological family. No member of my biological family will have a say in any medical treatment, burial details, or personal property disposition upon my death. So you see Morgan if you do your homework you can get around most of the objections Lambda has listed. Adoption, foster care, and issues dealing with children are not guaranteed by marriage. In fact most states can easily remove children from a home with little pretext. Being a parent in a heterosexual marriage can be detrimental to the parent’s civil rights. Have you been following the news coverage of the Utah couple charged with kidnapping their own son? The kidnapping charges were dropped, however the couple was charged with “custodial interference”. Have you noticed how adamant some gay theology proponents are about getting the conservative church to “approve” of their lifestyle? Members of the UFMCC could care less what the other denominations do, but members of the other denominations that are gay are very rabid in their obnoxious posts and ridicule of conservative Christians. Read James’ posts, he tried to show Biblically that homosexuality is not a sin and when I rebutted his verses his only option was to attack my faith, my salvation, and the historical interpretation of Scripture that dates back to the 1st century, and me. When I quoted St. Augustine all he could do was allude to Augustine’s disapproval of temple prostitutes. Why? Because deep down they know homosexuality is wrong! In a prior post you asked if I was as concerned about heterosexual immorality as I am homosexuality. Some heterosexuals are just as liberal about sexual matters where their sexual freedom is concerned as some homosexuals are with “civil unions”. As to your Jewish friend, is he Reformed, Conservative, Reconstructionist, Orthodox, Ultra-Orthodox or an ethnic Jew who does not practice his heritage? One of the early supporters of the gay political movement was the Jewish Anti-Defamation League. The reason is this organization understands the common bond the Jews and gay’s have in the Holocaust. They supported equal rights for the gay community, but some members draw the line at “civil unions”, especially the Orthodox and Ultra-Orthodox Synagogues. My last employers were ethnic Jews who observed the holy days only because of family tradition. They eat pork, don’t use two sets of dishes, etc. Most American Jews are Conservative, Reformed or Reconstructionist. Each branch has differing views of the Torah. Orthodox and Ultra-Orthodox Jews keep the letter of the Torah to the best of their ability. |
